In 2018, the US Securities & Exchange Commission (SEC) announced that Elon Musk, CEO and Chairman of this company, had agreed to settle the securities fraud charge brought by the SEC against him because he had posted misleading tweets causing Tesla's stock price to jump which led to significant market disruption. The settlements include requirements that Elon Musk and Tesla each pay a separate $20m penalty. The $40m in penalties will be distributed to harmed investors in a court approved process.

In 2017 the US Justice Department announced that SolarCity Corporation (purchased by Tesla Motors Inc in November 2016 after this alleged conduct) has agreed to pay $29.5m to resolve allegations that it violated the False Claims Act by submitting inflated claims on behalf of itself and affiliated investment funds to the US Dept of Treasury.

In 2018 the Oregon Attorney General announced the State of Oregon received $13m in a settlement with solar distributor Tesla Energy Solutions (formerly known as SolarCity) and its accounting firm Novogradac & Company LLP. The settlement resolves allegations that SolarCity and Novogradac together submitted false applications to the Oregon Dept of Energy resulting in more than $10m in unjustified Business Energy Tax Credits. The violations occurred before Tesla bought Solar City.
